Freshfields advises Deutsche GigaNetz GmbH on financing of fibre-optic expansion
Global law firm Freshfields Bruckhaus Deringer (‘Freshfields’) has advised Deutsche GigaNetz GmbH on a financing for the expansion of digital infrastructure in Germany.
The financing is provided by a syndicate of banks comprising ABN Amro, ING, KfW, KfW Ipex-Bank, Kommunalkredit Austria, LBBW, NatWest, NordLB and SEB. It consists of a capex and a revolving credit line. A significant part of the financing is an investment loan from KfW for digital infrastructure, which is granted under the financing by the consortium.
Besides the founders, Deutsche GigaNetz is strategically accompanied by InfraRed Capital Partners Limited. In addition, DWS Group had recently signed an agreement to acquire shares in Deutsche GigaNetz GmbH. Deutsche GigaNetz secured the financing in order to push ahead with the planned fibre roll-out in rural areas in Germany.
Freshfields advised Deutsche GigaNetz on all legal aspects of the financing. The team comprised partner Mario Hüther, Counsel Alexander Ruschkowski as well as Associates Laura Korndörfer and Marlin Jürgens (all Finance, Frankfurt). Partner Patrick Cichy, Principal Associate Jacob Fontaine and Associate Maximilian Kind (all Hamburg) advised on Corporate Law.
